FutureCeuticals operates as a provider of business-to-business services. Given our purpose to serve other businesses, we focus only on business consumers, prospective business customers, website users, and other individuals, including our service providers. To the extent we collect information online, we do so in order to better serve our business clients and their employees.

This Privacy Notice describes how FutureCeuticals (the “Company”, or “we,” “us,” or “our”) collects and processes personal information about our business customers, prospective business customers, website users, and other individuals, including service providers. It describes the Company’s practices regarding the collection, use, and disclosure of such information when you visit our websites (the “Sites”), when you communicate with us via email, and when you engage with us offline for business activities. It also describes the rights that residents of California may have regarding their personal information. By accessing the Sites and using our services, you agree to our collection and use of personal information as described herein and agree to our Terms of Use .

WHAT PERSONAL INFORMATION DO WE COLLECT?

In the 12 months preceding the date of this Policy, we may have collected your personal information when you visited our Sites, requested information about our products or services, engaged with us in connection with business activities, or when you voluntarily provided information to us. We will continue to collect personal information from the same sources.

The categories of personal information we may have collected from these sources during the 12 months preceding the date of this Policy, and will continue to collect, include the following, in addition to unstructured personal information you may voluntarily provide to us:

  • Personal identifiers : Name, address, email address, telephone numbers, IP address or other unique identifier, and other similar information.

  • Financial and insurance information : Bank account or credit card information.

  • Commercial information : Records of products purchased or considered, consuming histories or tendencies.

  • Internet or other electronic activity information : Device and browser type, your browsing and search history on our Sites, and information regarding your interaction with our Sites and our advertisements.

  • Geolocation information : IP address

  • Inferences drawn from the personal information identified above.

If you provide information to us about any person other than yourself, such as your employees or family members, you must ensure that they understand how their information will be used, and where required by applicable law, that they have given their permission for you to disclose it to us and for you to allow us, and our outsourced service providers, to use it.

On occasion, we may receive personal information from third-party sources, such as where our trusted suppliers provide anonymized web analytics and reporting services.

HOW DOES FUTURECEUTICALS USE THIS PERSONAL INFORMATION?

We use your personal information to provide you with information you request from us, to contact you from time to time, to provide you with news and other information about our Company, to engage in business with you, and for marketing purposes.

Additionally, we use personal information, including about your use of our Sites, to monitor or improve our Sites; for internal business analysis; to prevent fraud, activities that violate our Terms of Use or that are illegal; and to protect our rights and the rights and safety of our users or others.

Internet or other electronic network activity information: Device and browser type, your browsing and search history on our Sites, and information regarding your interaction with our Sites and our advertisements.

Service providers that provide data security services and cloud-based data storage; host our Sites and assist with other IT-related functions; provide website hosting, webcast and teleconference services; advertise and market our products; and provide analytics information.

Geolocation information: IP address

Service providers that provide customer relationship management (CRM) services; assist us in operating, analyzing, and displaying content on our website; provide analytics information; logistics companies, IT hosting and/or IT maintenance providers, or third-party storage or service-provider companies; advertise or market our products.

Additional Information About How We May Share Personal Information

In the 12 months prior to the date of this Policy, we may have shared information, and we may continue to share information, with other entities in the Van Drunen family of companies ( e.g., R.J. Van Drunen & Sons, Inc. d/b/a Van Drunen Farms; VDF FutureCeuticals, Inc.; Van Drunen Farms - Golden State Herbs, Inc.; Sur PhytoPerformance, LLC; and Nutrim, LLC ). Such information is shared in the ordinary course of business – including, for example, to provide products/services to you and administer/manage group functions. The California Consumer Privacy Act (CCPA) may view such information sharing as a “sale” of information, even though no payment is made for the information. If you would like to opt out of the sharing of information between entities within the Van Drunen family of companies, contact sales@futureceuticals.com. We do not otherwise sell personal information, and in the past 12 months have not otherwise sold your personal information, nor do we rent or sell customer lists.

We may share your personal information as required or permitted by law to comply with subpoena or similar legal process or government requests, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. We may also share your personal information with third parties to help detect and protect against fraud or data security vulnerabilities.

We may also transfer your personal information to a third party in the event of an actual or contemplated sale, merger, reorganization of our entity or other restructuring.

COOKIES AND OTHER TRACKING TECHNOLOGIES

When you visit our Sites, including from a mobile device, we may place a “cookie” or other online tracking technology (e.g., a web pixel, beacon, or GIF) that recognizes you. The cookies and other tracking technologies may also collect information about your IP address or actions taken in connection with the Sites. We may use cookies or similar tracking technologies to capture information about the use of our Sites, including to improve your user experience. Opting Out of Cookies . If you want to stop or restrict the placement of cookies or delete any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. By deleting our cookies or disabling future cookies, you may not be able to access certain areas or features of our Sites or some functionality may be affected. You can disable cookies from your computer system by following the instructions on your browser or at www.youradchoices.com.

Third-Party Analytics Tools . We use analytics tools, including third-party technologies such as Google Analytics to collect information and help us understand how visitors engage with our Sites. Google Analytics uses cookies and other identifiers to collect information, such as how often users visit the Sites, what pages they visit when they do so, and what other websites they visited prior to visiting our Sites. Third-Party Advertising Tools. Third parties may deliver cookies or other tracking technologies, including web beacons or tracking pixels, to your computer or mobile device for the purpose of tracking your online behaviors across nonaffiliated websites, and to deliver targeted advertisements on other nonaffiliated websites. For example, we use Google Ads to enhance our marketing and advertising efforts.

Opting Out of Interest-Based Advertising . The online advertising industry provides a service through which you may opt-out of receiving targeted ads from certain data partners and other advertising partners that participate in self-regulatory programs. You can opt-out of targeted advertising from certain providers at www.aboutads.info/consumers . To be clear, cookie-based opt-outs must be performed on each device and browser that you wish to have opted-out. For example, if you have opted out on your device browser, that opt-out will not be effective on your mobile device. You must separately opt out on each device. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities.

PERSONAL INFORMATION OF MINORS

Our products and services are not directed to minors under the age of 13 and we do not have actual knowledge that we collect personal information from such minors.

THIRD PARTY WEBSITES

Our Sites may contain social media buttons or links to third-party websites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on those social media platforms or third-party websites. We recommend that you review the privacy policies posted on any platform or website that you may access through our Sites.

HOW WE KEEP YOUR PERSONAL INFORMATION SECURE

We implement and maintain reasonable security measures appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. Those measures include administrative, physical and technical safeguards to protect the security, confidentiality and integrity of personal information. However, data security incidents and breaches can occur due to a variety of factors that cannot reasonably be prevented; therefore, our safeguards may not always be adequate to prevent all breaches of security.

If you are a California resident, you may have additional rights regarding your personal information, in accordance with California law.

California Consumer Privacy Act

The California Consumer Privacy Act (CCPA) gives California residents rights described below with respect to their personal information.

Your Right To Request Disclosure of Information We Collect and Share About You

We are committed to ensuring that you know what personal information we collect. To that end, you can ask us for any or all of following types of information regarding the personal information we have collected about you in the 12 months prior to our receipt of your request:

  • Specific pieces of personal information we have collected about you;

  • Categories of personal information we have collected about you;

  • Categories of sources from which such personal information was collected;

  • Categories of personal information that the business disclosed for a business purpose about the consumer;

  • Categories of third parties to whom the personal information disclosed for a business purpose; and

  • The business or commercial purpose for collecting your personal information.

Your Right To Request Deletion of Personal Information We Have Collected About You

Upon your request, we will delete the personal information we have collected about you, except for situations where the CCPA authorizes us to retain specific information, including when it is necessary for us to provide you with a good or service that you requested; perform a contract we entered into with you; maintain the functionality or security of our systems; or comply with or exercise rights provided by the law. The law also permits us to retain specific information for our exclusively internal use, but only in ways that are compatible with the context in which you provided the information to us or that are reasonably aligned with your expectations based on your relationship with us. We will act on your deletion request within the timeframes set forth below.

Your Right to Ask Us Not to Sell or Share Personal Information We Have Collected About You

With respect to those categories of personal information that we share with other entities in the Van Drunen family of companies (e.g., R.J. Van Drunen & Sons, Inc. d/b/a Van Drunen Farms; VDF FutureCeuticals, Inc.; Van Drunen Farms - Golden State Herbs, Inc.; Sur PhytoPerformance, LLC; and Nutrim, LLC) – which, as explained above, may be considered a “sale” under the CCPA, you have the right to opt out of such information sharing.

Exercising Your Rights and How We Will Respond

For requests for access or deletion we will first acknowledge receipt of your request within 10 business days of receipt of your request. We will provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances.

If we expect your request is going to take us longer than usual to fulfill, we will let you know.

We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations. In some cases, the law may allow us to refuse to act on certain requests. When this is the case, we will endeavor to provide you with an explanation as to why.

Our Commitment to Allowing You to Exercise Your Rights – Non-Discrimination

If you exercise any of the rights explained in this Policy, we will continue to treat you fairly. If you exercise your rights under this Policy, you will not be denied or charged different prices or rates for goods or services, or provided a different level or quality of goods or services than others.

Verification of Identity – Access or Deletion Requests

We will ask you for identifying information and attempt to match it to information that we maintain about you. If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to your request. We will notify you to explain the basis of any denial.

Authorized Agents

You may designate an agent to submit requests on your behalf. The agent must be a natural person or a business entity that is registered with the California Secretary of State.

If you would like to designate an agent to act on your behalf, you and the agent will need to comply with our verification process. If the agent submits requests to access, know or delete your personal information, the agent will need to provide us with your signed permission indicating the agent has been authorized to submit the request on your behalf. We will also require that you verify your identity directly with us or confirm with us that you provided the agent with permission to submit the request.

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with California law pertaining to powers of attorney.

Requests for Household Information

There may be some types of personal information that can be associated with a household (a group of people living together in a single dwelling). Requests for access to, or deletion of, household personal information must be made by each member of the household. To the extent we collect household information and requests are made pertaining specifically to such information, before responding to a request, we will verify the identity of each member of the household using the verification criteria explained above and will also verify that each household member is currently a member of the household.

California Shine the Light

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents that have an established business relationship with a business to annually request, free of charge, information about certain categories of personal information a business has disclosed to third parties for those parties’ direct marketing purposes in the preceding calendar year. California Do Not Track

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, our Sites do not respond to browsers’ “do not track” signals.

CHANGES TO THIS PRIVACY NOTICE

We will review and update this Privacy Policy periodically. We will notify you of material changes to it by posting on our Sites notification that the Policy has been updated and by updating the date of this Privacy Policy.
